1. Who we are
This Privacy Policy explains how PrefabHub (“PrefabHub”, “we”, “us”, “our”) collects, holds, uses and discloses personal information. PrefabHub is operated by FastMovingWater (ABN 52 389 335 280).
PrefabHub is an online platform at prefabhub.com.au that introduces people in Australia who are interested in prefabricated, modular, kit and granny-flat housing (“Buyers”) to builders, manufacturers and suppliers of those products (“Builders”).
2. What this policy covers
This policy covers personal information we collect through our website, our enquiry and lead-capture forms, email, telephone, SMS and any other channel through which you deal with us.
It does not cover what a Builder does with your information after we pass it on. Once we disclose your details to a Builder, that Builder handles your information under its own privacy policy and is separately responsible for its compliance. We encourage you to read the privacy policy of any Builder that contacts you.
3. What personal information we collect
3.1 Information you give us — Buyers
When you submit an enquiry, we typically collect:
- Your name
- Email address
- Phone number
- Suburb, postcode and/or State or Territory
- The type of project you are considering (for example granny flat, kit home, modular home, prefabricated dwelling)
- Your indicative budget range
- Your expected timeframe
- Whether you own or have access to land, and the status of that land
- Your stage in the process (for example researching, comparing quotes, ready to build)
- Any free-text notes, questions or project details you choose to provide
3.2 Information you give us — Builders and partners
If you register or enquire as a Builder or partner, we may collect:
- Your name, position and business contact details
- Business name, ABN/ACN and trading name
- Building licence or registration numbers and the issuing authority
- Service areas, product types and indicative pricing
- Insurance details, accreditations and industry memberships
- Billing and payment information
3.3 Information we collect automatically
When you visit our website we may collect:
- IP address and approximate geographic location derived from it
- Browser type, device type and operating system
- Pages viewed, time spent, referring URL and exit pages
- Date and time of access
- Cookie and similar identifiers (see section 10)
3.4 Sensitive information
We do not seek sensitive information as defined in the Privacy Act (such as health information, racial or ethnic origin, religious beliefs or political opinions). Please do not include sensitive information in free-text fields. If you volunteer sensitive information, you consent to us handling it for the purposes described in this policy.
3.5 Children
Our platform is directed at adults. We do not knowingly collect personal information from anyone under 18. If you believe we hold information about a minor, contact us and we will delete it.
3.6 Anonymity and pseudonymity
Under APP 2 you may deal with us anonymously or under a pseudonym where practicable — for example when browsing our site or making a general enquiry. However, we cannot introduce you to a Builder without your real contact details, because a Builder needs them in order to respond to you.
4. How we collect personal information
We collect personal information:
- Directly from you — through forms on our website, by email, by phone, by SMS or in correspondence
- Automatically — through cookies, analytics and server logs
- From third parties — including referral partners, advertising platforms, publicly available business registers and licence registers (for Builder verification)
Where we collect your information from a third party, we will take reasonable steps to notify you of the matters in APP 5 unless an exception applies.
5. Why we collect, hold, use and disclose your information
5.1 Primary purpose — Buyers
Our primary purpose in collecting your information is to disclose it to one or more Builders so that those Builders can contact you about your project. This is the core function of the platform. If you do not want your information given to Builders, do not submit an enquiry.
5.2 Other purposes
We also use personal information to:
- Match your enquiry to Builders whose products, price points and service areas suit your stated requirements
- Verify and administer Builder accounts and check licensing and accreditation
- Respond to your questions and provide customer support
- Send you information about your enquiry and its progress
- Send you marketing communications where permitted (see section 7)
- Improve, secure and analyse the platform, including through aggregated and de-identified reporting
- Prevent fraud, misuse and abuse of the platform
- Meet our legal, regulatory, accounting and record-keeping obligations
- Resolve complaints and disputes
5.3 Secondary purposes
We will only use or disclose personal information for a secondary purpose where you would reasonably expect it and it is related to the primary purpose, where you have consented, or where the use or disclosure is otherwise permitted under APP 6.
6. Who we disclose your information to
6.1 Builders
We disclose Buyer enquiry information to Builders. You should be aware:
- We may disclose your enquiry to more than one Builder, so that you can compare options.
- We are generally paid by Builders — by subscription, per-lead fee, or commission — in connection with introductions made through the platform.
- Builders are independent third parties. They are not our agents, employees or partners. We do not control what they do with your information once disclosed.
- Each Builder is responsible for its own compliance with the Privacy Act, the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth).
6.2 Service providers
We disclose personal information to suppliers who help us run the platform, including:
- Website and application hosting providers
- Database and backend infrastructure providers
- Email delivery and marketing platforms
- Customer relationship management (CRM) systems
- Analytics and advertising platforms
- Payment processors (for Builder billing)
- Professional advisers such as lawyers and accountants
6.3 Other disclosures
We may disclose personal information:
- Where required or authorised by law, including under a subpoena, court order or regulatory request
- To a purchaser or prospective purchaser in connection with a sale of our business or assets, subject to confidentiality
- Where you have consented
We do not sell personal information to data brokers or list resellers.
7. Direct marketing
Under APP 7, we may use your personal information to send you direct marketing about our services and about prefabricated and modular housing generally, where:
- You have consented, or
- You would reasonably expect us to do so given the circumstances in which we collected the information
Every marketing message will contain a working unsubscribe facility, and we will action unsubscribe requests promptly.
You may ask us at any time to:
- Stop sending you direct marketing
- Tell you where we obtained your information
Contact us using the details in section 13.
7.1 Contact by Builders — telephone, SMS and email
By submitting an enquiry, you expressly consent to being contacted by the Builder(s) we introduce you to, by telephone, SMS and email, about your enquiry. This consent is given for the purposes of the Do Not Call Register Act 2006 (Cth) and the Spam Act 2003 (Cth), and it applies even if your number is listed on the Do Not Call Register.
You may withdraw this consent at any time by contacting us, or by telling the relevant Builder directly. Withdrawal takes effect prospectively — we cannot recall information already disclosed.
8. Overseas disclosure
We store personal information in Australia and do not routinely disclose personal information to overseas recipients.
9. Security, retention and data breaches
9.1 Security
We take reasonable technical and organisational steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure, including encryption in transit, access controls, and restricting staff access to what is necessary.
No system is completely secure. We cannot guarantee the security of information transmitted to us over the internet.
9.2 Retention
We retain personal information only for as long as we need it for the purposes described in this policy, or as required by law. As a general rule we retain Buyer enquiry records for 7 years to manage disputes and meet record-keeping obligations, after which we destroy or de-identify the information.
9.3 Notifiable data breaches
If we suffer a data breach that is likely to result in serious harm to affected individuals, we will assess and respond in accordance with the Notifiable Data Breaches scheme in Part IIIC of the Privacy Act, and notify affected individuals and the Office of the Australian Information Commissioner (“OAIC”) as required.
10. Cookies and analytics
We use cookies and similar technologies to operate the site, remember your preferences, measure traffic and support advertising.
| Type | Purpose |
|---|---|
| Strictly necessary | Core site function, security, form submission |
| Analytics | Understanding how the site is used, measuring performance |
| Advertising | Measuring campaign effectiveness and showing relevant ads |
You can control cookies through your browser settings. Blocking cookies may affect how the site works.
We use web analytics tools such as Google Analytics. Such providers may collect information subject to their own privacy policies.
11. Accessing and correcting your information
Under APP 12 and APP 13 you may request:
- Access to the personal information we hold about you
- Correction of information that is inaccurate, out of date, incomplete, irrelevant or misleading
To make a request, contact us using the details in section 13. We will respond within a reasonable period, generally 30 days. We do not charge for making a request; we may charge a reasonable cost-based fee for giving access.
If we refuse access or correction, we will give you written reasons and tell you how to complain.
Deletion: Australian law does not currently give a general “right to be forgotten”. However, we will delete or de-identify your information on request where we no longer need it and are not required to retain it.
12. Complaints
If you think we have breached the APPs or mishandled your personal information:
Contact us. Write to hello@prefabhub.com.au setting out your complaint.
Complaints about a Builder. If your complaint concerns how a Builder has handled your information, raise it with that Builder first. We are happy to pass on your concerns, but we are not responsible for a Builder’s privacy practices.
